Jia v. People’s Republic of China
Case Summary
Jia v. People’s Republic of China (PRC) challenges China’s efforts to export its repression around the world and to target those who dare criticize the Chinese Communist Party (CCP).
The Plaintiffs are two petitioners who were brutally persecuted by the PRC and now live in the United States, where they routinely call for justice and protest the CCP. They allege that they were attacked by the PRC or its co-conspirators in November 2023 when they travelled to protest the CCP during Xi Jinping’s visit to San Francisco for a summit of the Asia-Pacific Economic Cooperation (APEC) forum. The Plaintiffs allege that PRC Embassy and consular officials conspired with others to suppress protest of the CCP during the summit, including through violence.
Plaintiffs allege that the PRC is liable for assault, battery, intentional infliction of emotional distress, and bias-motivated violence under California’s Ralph Civil Rights Act.
